EU In Vitro Diagnostic Regulation (EU) 2017/746 (IVDR)
Record ID: biomedical-reg-005 (Biomedical · regulation · license) Issuing body / enforcer: European Commission; enforcement by EU member-state competent authorities and Notified Bodies; MDCG coordination Jurisdiction: European Union / European Economic Area
1. What it is
The IVDR is the EU regulation governing in vitro diagnostic medical devices — reagents, instruments, and systems for examining human specimens. It replaced the IVD Directive (98/79/EC) with a risk-based regime modeled on the MDR. Its defining shock: under the old Directive roughly 80% of IVDs were self-certified with no Notified Body involvement; under the IVDR that ratio has flipped — ~80% now require Notified Body review. This single change created the Notified Body capacity crisis that has driven every subsequent deadline extension.
The IVDR has applied since 26 May 2022, but its legacy-device transition is still running — and the interim milestones are the live compliance calendar for diagnostics companies.
2. Scope and who it applies to
- Applies to IVDs across four risk classes: Class A (lowest, e.g., general lab instruments), B, C (high individual and/or moderate public health risk, e.g., many infectious-disease and companion-diagnostic-adjacent assays), D (highest, e.g., blood-screening and high-risk infectious disease tests).
- Companion diagnostics (CDx) are explicitly regulated under the IVDR with consultation requirements involving medicines authorities.
- Applies to manufacturers, authorized representatives, importers, distributors; health institutions manufacturing in-house devices face specific (narrower) obligations.
- Triggers: Placing an IVD on the EU/EEA market or putting it into service.
3. Key requirements and compliance obligations
- Conformity assessment by class: Class A (non-sterile) can be self-certified; Class A sterile, B, C, and D require Notified Body involvement of increasing intensity (QMS audit + technical documentation assessment; Class D adds EU reference laboratory batch verification for the highest-risk assays).
- Performance evaluation (Article 56, Annex XIII): The IVD analogue of clinical evaluation — scientific validity, analytical performance, and clinical performance demonstrated through a Performance Evaluation Plan and Performance Evaluation Report, continuously updated. For novel markers without established scientific validity, this is a heavy lift.
- GSPRs (Annex I), technical documentation (Annexes II–III), UDI, EUDAMED registration — parallel to the MDR structure (see shared brief
eu-mdr-2017-745.md). - Post-market performance follow-up (PMPF): The IVD version of post-market clinical follow-up — planned, proactive collection of performance data from real-world use.
- Vigilance and PMS: Serious-incident reporting, trend reporting for non-serious incidents with statistical significance, Periodic Safety Update Reports for higher classes.
- QMS: IVDR-compliant QMS required (EN ISO 13485:2016+A11:2021 in practice).
4. Penalties and consequences of non-compliance
- National competent-authority enforcement: market withdrawal, prohibition, certificate suspension/withdrawal by the Notified Body, and nationally set administrative penalties (vary by member state — cite the national law).
- Loss of Notified Body certification = loss of EU market access for Class B/C/D devices.
- IVD vigilance failures (late serious-incident reporting) are a distinct enforcement trigger under the IVDR's trend-reporting obligations.
5. Version and transition status — VERIFIED (September 2026)
- IVDR (EU) 2017/746 entered into force 25 May 2017, date of application 26 May 2022.
- Transition extension — Regulation (EU) 2024/1860 (verified via September 2026 regulatory sources): legacy IVDs (covered by an IVDD certificate or declaration of conformity before 26 May 2022) may remain on the market until:
- 31 December 2027 — Class D (highest risk); IVDD-certified devices (any class, previously NB-certified);
- 31 December 2028 — Class C;
- 31 December 2029 — Class B and sterile Class A.
- Conditions — the interim milestones are the trap: the extension is not automatic. Manufacturers must have had an IVDR-compliant QMS in place by 26 May 2025 (all classes), and must hit class-specific gates:
- Class D: formal NB application by 26 May 2025, signed NB agreement by 26 September 2025;
- Class C: formal NB application by 26 May 2026, signed agreement by 26 September 2026;
- Class B / sterile A: application by 26 May 2027, agreement by 26 September 2027.
- Plus: no significant changes, continued IVDD compliance, no unacceptable risk.
- ⚠️ Live urgency (September 2026): The Class C signed-agreement deadline of 26 September 2026 has just passed at the time of writing. Any Class C legacy manufacturer without a signed Notified Body agreement by that date has lost the extended transition and faces market removal until full IVDR certification (currently averaging 18–24 months). Verify individual situations against the regulation text — this is the single most time-critical IVDR fact in this brief.
- The old sell-off provisions were removed (Regulation 2023/607 mechanism applied to IVDR) — qualifying legacy devices already placed on the market are not subject to a fixed disposal date.
- Watch item: The EC December 2025 simplification proposal may touch IVDR obligations but is not law as of September 2026.

From the catalogue (record_type=certification, importance=license/flagship, Biomedical):
- RAC-Devices (RAPS) — IVDR conformity routes, performance evaluation, and the transition milestones are tested content.
- CCE — tangential.
- PE — no biomedical PE exam; not tested.
7. Honest flags
- Transition dates/milestones verified against multiple September 2026 sources (SGS, i3cglobal, DLRC, LinkedIn regulatory analysis) — consistent on the 2024/1860 framework and interim gates. The "Class C agreement deadline just passed" reading follows from the verified 26 September 2026 date and today's date (30 September 2026).
- Penalty specifics are member-state-dependent; described generally here.
- Confirm EUDAMED IVD-module mandatory status separately — the database rollout affects IVDs on its own module schedule.
